1. Services and Products offered by third parties

It may be possible to order and use also products and services of third parties through the Service. It will be clearly stated in the Service when the product or service is offered by a third party and the Service Provider shall not take any responsibility or be liable for any actions, omissions, products or services by third parties.

2. Pricing and payment

Prices for products are made available in the Service. Prices include the value added tax (VAT) as applicable by law. Prices are subject to change without notice. Payment will be done at the time of purchase using the available payment methods.

3. Payment methods

Products and possible delivery costs are paid at the time of purchase. We accept VISA, Visa Electron and MasterCard. Payment can also be made via PayPal.

4. Delivery of the products

Products purchased by the User are delivered and made available through the User’s personal profile in the Service. The Service Provider shall deliver a confirmation (receipt) of the order by e-mail. The purchased product will be activated in two (2) working days after the purchase at the latest.

The User is always responsible to make sure that the User’s computer, the related software programs and network connections are sufficient for the purposes of using the products to be acquired by the User from the web store. Dodreams Ltd shall not be liable if the products that the User has bought will not work due to insufficiency of the User’s computer, the related software programs or the network connections.

5. Cancellation, defected product and reclamation

The User’s right to use the products and services begins immediately after the payment has been done and before the cancellation period provided in the Finnish Consumer Protection Act ends. Therefore, the User has no right to cancel the order or purchase.

If the User considers that the product or service provided by the Service Provider is defective, the User must notify the Service Provider in reasonable time after the User became aware of the defect. However, in any event all such notices (reclamations) must be done within two (2) weeks after the first working day following the race or other event that is claimed to be defective.

6. Changing terms of use and Service

Dodreams Ltd reserves the right to change these terms of use. Minor changes in the terms of use will be communicated through the Service or in other similar manner. Changes come into effect at the declared date and shall be applied to all purchases made after such date. Substantial changes in these terms of use will be communicated to the User by e-mail or through the Service.

Dodreams Ltd has the right to produce the Service in a way it finds best and it has the right to amend and change the content, technology and/or usage of the Service. The Service Provider has also the right to stop to produce the Service at any time without prior notice and Dodreams Ltd with its cooperation partners can’t assure that products or services are always available. Furthermore, Dodreams Ltd has the right to restrict the User’s access to the Service and cease to produce the Service or any part of it.

7. Right to restrict access

Dodreams Ltd has the right to prevent User’s access to the Service if the User acts to the contrary of or breaches these terms of use.

8. Liability of the Service Provider

Dodreams Ltd shall not be liable for the interruptions or data communications failures or any delays regarding the Service availability resulting from those. Dodreams Ltd shall have no liability for the inconvenience, expenses or direct or indirect damages caused by or resulting from any interruptions regarding delivery of the Service.

The Service Provider cannot guarantee the undisturbed, uninterrupted or error free operation of the Service. There may also be errors relating to the content of the Service and the software programs related to the Service. The Service Provider shall not be liable for the damages or any other losses caused by or resulting from any non-availability of the Service or excessive traffic in the Service.

The Service Provider shall only be liable to the User for the damage that has occurred when the User has made the payment required by the Service and has definitively lost the opportunity to use the product or service for which the payment was made. In such an event, the amount of damage shall not be more than what the User has paid for the respective product or service.

The Service Provider shall not be liable for the accuracy of the content of the messages or other materials existing in the Service.

The User uses the Service at his/her own risk. The Service Provider shall not be liable of the actions of other players in the Service or the possible infringements the privacy or other rights of the User.

The Service Provider has the right to amend or cease to produce the Service or any part of it at any time without prior notice. The Service Provider shall not be liable for the consequences caused to the User as a result of such amendment or cessation. Provided that the Service Provider permanently ceases to produce the Service, the Service Provider compensates all paid-up participation fees that are unused at the time of such permanent closedown of the Service. Aforesaid doesn’t apply to temporary interruptions or failures of the Service.

Dodreams Ltd’s liability for damages is restricted as far as allowed by the mandatory laws of Finland. Neither party shall be liable for the damage caused to the other party due to force majeure events.

9. Force majeure

A force majeure event shall discharge the Service Provider from its obligations with respect to the Service in the event that the said force majeure event prevents or unreasonably impedes the performance pertaining to the Service. Examples of force majeure include fire, earthquake, flood, explosion, strike or other stoppage of work, orders of public authorities, disruption of energy supplies, shortage of raw materials or equipment, disruption of cable or other data communications caused by or arising from outside factors, or other comparable causes that were not foreseen and that could not reasonably have been prepared for in advance.

The Service Provider shall seek to announce force majeure through the Service immediately whenever such announcement is possible.

10. Other terms

Dodreams Ltd has the right to transfer the Service, the maintenance of the Service and the contractual relationships with the Users (customership) relating to the Service to another company.

Dodreams Ltd has the right to use subcontractors to fulfil its obligations hereunder.

11. Applicable law

Disputes relating to the use of Service and to these terms of use shall be governed by and construed in accordance with the laws of Finland, excluding its choice of law provisions.

For the sake of clarity, the User recognizes that the Service is global and thus accessible for User’s from different jurisdictions. As a result you as a User agree at all times to comply with all applicable local laws and rules in your country when using the Service and refrain from using the Service if the mandatory local laws or rules are in conflict with these terms of use.
